Dear John:

This letter is a final response to your September 8, 1999 letter. At the request of the CIA, the League of Wisconsin Municipalities attorney recently gave his opinion that records which were made while the CIA was handling itself as a private organization would not necessarily be open records but could be made public on a case by case basis by the CIA. I have already provided a copy of that memo to you.

In a discussion between myself and District Attorney Wambach on September 10, 1999 I assured him that all future meetings of the JDC would be in compliance with the open meetings/open records statutes. However, I expressed the concerns of some of the JDC board members about the confidentiality of certain information which, had the JDC been operating under open meetings/open records requirements, would surely been conducted in closed session. Since there was a presumption that our meetings were private, we need to ensure the confidentiality of our prospects who were also under that presumption. Mr. Wambach suggested a meeting to determine exactly what information you may desire but which would normally be exempt from the open meetings/open records requirements.

As for the financial reports for the JDC, these reports are printed quarterly and distributed to board members. However, copies have never been maintained because the information is always superseded during the next quarterly report. A current balance sheet is enclosed. This balance sheet lists all the JDC assets. There are no physical assets of the JDC.

There are no audio recordings of JDC meetings available other than the one which was provided to you last week (for the August 17, 1999 meeting). All future recordings will be preserved in compliance with the Wisconsin Statutes. The minutes for the August meeting, which were approved at the JDC meeting of September 21, l 999, are enclosed.

As per your request I will provide floppy disks of as much information is available in that format. All other information will have to be hard copies.

The minutes, agendas and financial reports will continue to be maintained in the JDC office.

Your August 20, 1999 letter was in regards to the CIA, not the JDC. However, so that the JDC board is aware, you received a response on September 10, 1999.

As per District Attorney Wambach's suggestion, I would like to schedule a meeting with you and some of the JDC board members to discuss how the JDC can respond to your request while safeguarding confidentiality as allowed by the open meetings statutes.
