Re: Records Request

Dear Mr. Reichertz:

In response to your records request, I enclose a copy of the database in print form, as it is the only copy made available to me by the JCEDC. I also enclose the September 19, 2001, response of Sheldon Mielke, President of the JCEDC, addressing your other requests. It appears that the Tourism Council minutes do not exist, and that the JCEDC takes the position that records concerning the Visitor's Guide other than as disclosed in the Annual Report (copy enclosed) are “privileged”.

I am unable to further respond to your request in that Jefferson County does not have custody of the records sought, or in the case of the database, said record in electronic format. By copy of this letter, I am asking the JCEDC to either forward the records requested or state its final position with regard to the electronic format issue taken under advisement, and state the basis of its privilege claim in the context of open records law regarding the availability of the Visitor's Guide records. Should either a response or further records become available, I will forward that information to you upon receipt.
